Privacy Policy (GDPR) · effective from January 31, 2024

I. Privacy Policy

1.1 By submitting an order from the online order form for the provision of services or by entering an email address in the designated field to receive specific information, the user confirms that they are familiar with the privacy policy, express their consent to its terms, and accept it in its entirety.

1.2 The Provider is the controller of users' personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter the "GDPR"). The Provider undertakes to process personal data in accordance with legal regulations, in particular the GDPR.

1.3 Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

1.4 When placing an order or requesting information via email with the client's consent, personal data necessary for the successful processing of the request or order (name, address, contact details) is required. The purpose of processing personal data is to fulfill the user's order and to exercise the rights and obligations arising from the contractual relationship between the Provider and the User. Furthermore, the purpose of processing personal data includes sending commercial information and other marketing activities. The legal basis for processing personal data is the performance of a contract pursuant to Article 6(1)(b) of the GDPR, compliance with a legal obligation of the controller pursuant to Article 6(1)(c) of the GDPR, and the legitimate interest of the Provider pursuant to Article 6(1)(f) of the GDPR. The Provider's legitimate interest is the processing of personal data for direct marketing purposes.

1.5 The Provider uses the services of subcontractors to fulfill the license agreement, primarily email service providers (personal data may be stored in third countries) and web hosting providers. Subcontractors are vetted for secure personal data processing. The Provider and the web hosting subcontractor have entered into a data processing agreement, under which the subcontractor is responsible for the proper security of the physical, hardware, and software perimeter, and thus bears direct liability to the user for any breach of personal data security.

1.6 The provider retains the user's personal data for the period necessary to exercise the rights and obligations arising from the contractual relationship between the provider and the user and to assert claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).

1.7 The user has the right to request access to their personal data from the provider pursuant to Article 15 of the GDPR, the correction of personal data pursuant to Article 16 of the GDPR, or the restriction of processing pursuant to Article 18 of the GDPR. The user has the right to the erasure of personal data pursuant to Article 17(1)(a) and (c) through (f) of the GDPR. Furthermore, the user has the right to object to processing pursuant to Article 21 of the GDPR and the right to data portability pursuant to Article 20 of the GDPR.

1.8 The user has the right to file a complaint with the Office for Personal Data Protection if they believe that their right to personal data protection has been violated.

1.9 The user is under no obligation to provide personal data. However, the provision of personal data is a necessary requirement for the conclusion and performance of the contract, and without providing personal data, it is not possible to conclude the contract or for the provider to fulfill it.

1.10 The provider does not engage in automated individual decision-making within the meaning of Article 22 of the GDPR.

1.11 By filling out the contact form, individuals interested in the provider's services agree to the use of their personal data for the purpose of electronic delivery of commercial offers, advertising materials, direct sales, market research, and direct product offers by the provider and third parties, no more than once a week. They also declare that they do not consider the sending of this information to be unsolicited advertising, as they have explicitly consented to it. The user may withdraw their consent under this paragraph at any time in writing at sales@teslaeh.eu.

1.12 To improve service quality, personalize offers, collect anonymous data, and for analytical purposes, the provider uses so-called cookies on its website. Details can be found on the Cookie Settings page.

The provider hereby declares that the protection of personal data is subject to the provider's internal security regulations.

Only authorized persons of the provider and subcontractors under these terms and conditions will have access to personal data, and they will be subject to the conditions and scope of data processing established by the provider; each such person will access personal data under their own unique identifier.

The provider's authorized persons who process personal data in accordance with these terms and conditions are obligated to maintain confidentiality regarding personal data and security measures, the disclosure of which would compromise their security. The provider shall ensure that they are demonstrably bound by this obligation. The provider shall ensure that this obligation remains in effect for both the provider and the authorized persons even after the termination of their employment or other relationship with the provider.

The provider will assist the user through appropriate technical and organizational measures, insofar as possible, in fulfilling the user's obligation to respond to requests for exercising the data subject's rights as set out in the GDPR, as well as in ensuring compliance with the obligations pursuant to Articles 32 to 36 of the GDPR, taking into account the nature of the processing and the information available to the provider.
